Terms of Use
Draft — pending legal review. Not yet reviewed by a solicitor. Every ACT-specific detail marked [ACT to confirm] must be supplied before publication.
Who these terms are with
These terms are between you and ACT Foundation International, a charity registered with the Charity Commission for England and Wales, no. 1149049 (the “Charity,” “we,” “us,” “our”). By using this site you accept these terms. If you do not accept them, please do not use the site.
What the site is
This site describes ACT's work and, once payments are enabled, accepts donations. Nothing on the site is a promise of a particular outcome for any single gift, a professional service, an offer of employment, or legal, tax or medical advice.
Your account
The site does not currently offer accounts. If we introduce them, additional terms will govern them, and we will tell you before you sign up.
Donations
- When you make a gift, you enter into a donation contract with the Charity for the amount you enter.
- Gifts are collected in euros unless a specific campaign states otherwise.
- Gifts are non-refundable except in the circumstances set out in our Donation & Refund Policy.
- We do not currently claim tax exemption in any jurisdiction on your behalf. If you believe your gift may qualify (for example, UK Gift Aid), please write to us before giving.
- If your gift names a specific initiative, programme or campaign, we will direct it there unless that work becomes over-funded or is discontinued, in which case we will contact you or, if that is not possible, redirect it to a closely related programme.
What you may not do on the site
- attempt to break, scrape at scale, or degrade the site;
- use the site to send unlawful, harassing or misleading content;
- impersonate anyone, including ACT staff, volunteers or donors;
- use the newsletter or donation forms to test payment cards or credentials;
- copy the site's design, code or photography for another organisation.
Intellectual property
The site's content, code and design are ACT's, or used with permission from the person or organisation named. You may quote short passages with attribution for journalism, research or education. Photographs of named individuals may not be used elsewhere without our written permission (and, in some cases, the individual's own consent).
Third-party marks named on the site belong to their respective owners. Naming them here is descriptive; it is not an endorsement.
Third-party links
The site links to third-party sites. We do not control what those sites publish, and we are not responsible for their content or their privacy practices. Read their terms before you use them.
The site is provided “as is”
We take care of the site, but we do not warrant that it will be uninterrupted, error-free or free of everything unpleasant on the wider internet. To the maximum extent permitted by law, we exclude implied warranties.
Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation. To the maximum extent permitted by law, our liability to you for any other matter arising out of your use of the site is limited to the amount you have donated in the twelve months before the claim, or £100, whichever is greater.
If you are a consumer
If you are a consumer, you have statutory rights that these terms cannot take away — for example, in the UK under the Consumer Rights Act 2015, and in the EU under the Consumer Rights Directive and national implementations. These terms do not affect those rights.
Governing law
These terms are governed by the laws of England and Wales. Disputes will be resolved in the courts of England and Wales, except that if you are a consumer resident in the EU, EEA or UK, you may bring proceedings in the courts of your country of residence and rely on the mandatory consumer protections of your local law.
Changes
We may update these terms. Material changes are announced at the top of the site for 30 days before they take effect. Continued use of the site after that date is acceptance of the new terms.
